Actor Snipes gets 3 years, apologizes for `costly mistakes'

OCALA, Fla. - After haggling with revenue agents, criminal investigators and eventually U.S. prosecutors for almost a decade, Wesley Snipes finally caught them by surprise.

Hours before he was to be sentenced Thursday for failing to file income taxes he insisted he never had to pay, the action star cut the federal government three checks for $5 million, delivered in court.

So taken aback were prosecutors that they first declined the cash. But by the end of the day, the government took the money and more — a maximum three-year sentence for its highest-profile criminal tax target in decades.

"The sentencing court sends the right message to the American taxpayer — you've got to pay your taxes," U.S. Attorney Robert O'Neill told reporters outside the usually quiet central Florida courthouse. "Rich, poor, it doesn't matter. We all pay our taxes."

Though Snipes was convicted of three counts of willfully failing to file returns, his trial was held by some as proof of victory for the tax protest movement. Snipes was acquitted of five other charges, including felony tax fraud and conspiracy, that would've exposed him to 13 more years in prison.

Criminal tax prosecutions are relatively rare — usually the cases are handled in civil court, where the government has a lower burden of proof.

Snipes' attorneys argued the sentence was too stiff for a first-time offender convicted of three misdemeanors, and recommended he be given home detention and ordered to make public service announcements.

But U.S. District Judge William Terrell Hodges said Snipes exhibited a "history of contempt over a period of time" for U.S. tax laws.

"In my mind these are serious crimes, albeit misdemeanors," Hodges said.

The action star of the "Blade" trilogy, "White Men Can't Jump," "Jungle Fever" and other films hasn't filed a tax return since 1998, the government alleged. Snipes and the IRS still must determine how much he owes, plus interest and penalties. The government alleged Snipes made at least $13.8 million for the three years in question, owing at least $2.7 million in back taxes on them alone.

Snipes read aloud from a prepared apology, calling his actions "costly mistakes" but never mentioning the word "taxes." He said he was the victim of crooked advisers, a liability of wealth and celebrity that attract "wolves and jackals like flies are attracted to meat."

"I am an idealistic, naive, passionate, truth-seeking, spiritually motivated artist, unschooled in the science of law and finance," Snipes said.

His lawyers said he was no threat to society, and offered three dozen letters from family members, friends and even fellow actors Woody Harrelson and Denzel Washington attesting to his compassion, intelligence and value as a mentor. They called four character witnesses Thursday, including television's Judge Joe Brown, who incited applause from the gallery by suggesting Snipes was no different than "mega-corporate entities" that legally avoid taxes.

Hodges twice halted the proceedings to quiet the crowd, threatening to clear everyone out if they made another outburst.

Snipes' co-defendants, Douglas P. Rosile and Eddie Ray Kahn, were convicted on both felony counts on which the actor was acquittal. Kahn, who refused to defend himself in court, was sentenced to the maximum 10 years, while Rosile received 4 1/2 years. Both will serve three years of supervised release.

Snipes and Rosile remain free and will be notified when they are to surrender to authorities. Defense attorney Carmen Hernandez signaled in court that Snipes would pursue an appeal.

Kahn was the founder of American Rights Litigators, and a successor group, Guiding Light of God Ministries, that purported to help members legally avoid paying taxes. Snipes was a dues-paying member of the organization, and Rosile, a de-licensed accountant, prepared Snipes' paperwork.

The actor maintained in a yearslong battle with the IRS he did not have to pay taxes, using fringe arguments common to "tax protesters" who say the government has no legal right to collect. After joining Kahn's group, the government said, Snipes instructed his employees to stop paying their own taxes and sought $11 million in 1996 and 1997 taxes he legally paid.

Defense attorneys Hernandez and Daniel Meachum said Snipes was unfairly targeted because he's famous. Meachum called prosecutors "big game hunters," selectively prosecuting the actor while Kahn's some 4,000 other clients remained free.

Hodges was not swayed.

"One of the main purposes which drives selective prosecution in tax cases is deterrence," the judge said, while denying it had anything to do with his sentence. "In some instances, that means those of celebrity stand greater risk of prosecution. But there's nothing unusual about it, nor is there anything unlawful about it. It's the way the system works."

NEW ORLEANS - President Bush, replying to criticism from Democratic presidential candidates, said Tuesday that "now is not the time to renegotiate ... or walk away from" the North American Free Trade Agreement. He also denied the U.S. was in a recession, calling it a slowdown instead.

Bush also used a joint news conference with Mexican President Felipe Calderon and Canadian Prime Minister Stephen Harper to renew his call for Congress to pass a free-trade pact with Colombia. He said House Speaker Nancy Pelosi's refusal to schedule a vote could effectively kill it this year.

"It makes no sense to me to say that Colombian goods can come into our country duty-free, yet our goods can't go into Colombia duty-free," Bush said sternly. "And yet that's the case. An agreement with Colombia would level the playing field."

Asked about the state of the U.S. economy, Bush said: "We're not in a recession. We are in a slowdown."

"I'm obviously concerned for our consumers," the president said. He was asked whether the rising cost for gasoline will erode the potential positive impact of the $168 billion economic stimulus package passed by Congress, but did not specifically answer.

"No question that rising gasoline prices are like a tax on our working people," Bush said.

Some of Bush's strongest words came in defending NAFTA, which took effect in 1994.

The three-way trade pact has been criticized by both Democratic Sens. Hillary Rodham Clinton and Barack Obama, who have promised to try to renegotiate the agreement if elected president. Bush's comments came on the day of the critical Pennsylvania primary, in which trade — and the loss of manufacturing jobs in the United States — has been a top issue.

"Now is not the time to renegotiate NAFTA or walk away from NAFTA," Bush said. "Now is the time to make it work better for all our people, and now is the time to reduce trade barriers worldwide."

Bush was asked if he thought he was losing the free-trade debate in the court of public opinion because of the strong opposition to NAFTA from the two Democratic rivals.

"My biggest concern on trade is with Colombia. NAFTA exists," Bush said, saying the pact was mutually beneficial to the United States as well both of its North American neighbors.

Both Calderon and Harper echoed Bush's comments on standing by the agreement and not reopening it.

"We agreed that this is not the time to even think about amending it or canceling it. This is the time to strengthen and reinvigorate it," the Mexican president said.

"Jobs have grown in all three" countries as a result of NAFTA, Calderon said. "The benefits are visible."

Calderon said he was respectful of the domestic politics of the United States and that "it is not my role" to talk to any of the presidential candidates about NAFTA. But he made clear that he wants Clinton and Obama to keep their hands off NAFTA.

"To talk about taking a step backwards in terms of free trade, in the case of Mexico, would effectively provoke considerable damage on the economy," Calderon said. Further, he said, that "It would be a sudden loss of economic opportunities that would even lead to even greater migratory pressure against the United States."

Harper said NAFTA was "important for jobs and posterity on both sides of the border."

He said it would be a mistake to renegotiate the agreement, but that Canada would be willing to take part in revisiting the agreement if the other partners insisted.

The Canadian president also said the pact and other economic agreements help to keep energy flowing smoothly. "Canada is the biggest and most stable supplier of energy in the world," he said.

On the pending Colombian trade pact, Bush singled out Pelosi, saying if she doesn't schedule a vote on Colombia, she will have killed it.

"She's going to have to explain why the voices of false populism have been strengthened," Bush said, referring to leftist Latin American leaders like Venezuela's President Hugo Chavez.

Layoffs in U.S. manufacturing and the current economic slowdown have made NAFTA and other free-trade deals the subject of intense criticism in the Democratic-led Congress. Both Obama and Clinton want to renegotiate it to add labor and environmental protections.

"I'm concerned about protectionism in America. It is not in our interest to become a projectionist nation," Bush said.

Earlier, Bush shared green onion omelets, grits and sides of Canadian bacon with the neighboring leaders on the last day of a summit showing solidarity on cross-border trade.

They ate the family style breakfast at Dooky Chase's Restaurant which was flooded by four feet of water during Hurricane Katrina. The establishment, a gathering place for black musicians and politicians in the 1960s, is owned by Leah Chase, known as the "Queen of Creole Cuisine."

Dalai Lama: Preserve religious traditions, respect others

ANN ARBOR, Mich. (AP) — The Dalai Lama on Saturday encouraged people gathered at the University of Michigan to preserve their own religious traditions while respecting others with differing beliefs.

"As you know, I always believed since all different traditions have the same potential to bring inner peace, inner value ... it is important to keep one's own tradition," he told about 8,000 people at Crisler Arena.

The exiled Tibetan spiritual leader said he learned about Islam, Christianity and Judaism through personal contact and that he has a "genuine admiration and respect and appreciation for those traditions."

Sharon Drews, a Catholic and a lawyer, drove from Elkhart, Ind., with her mother to attend the Saturday morning teaching session, and said afterward that she appreciated the Dalai Lama's message.

"The most valuable thing for me was that he said there are so many (religious) traditions leading to the same self-improvement, but we need to allow people to follow the tradition that's most effective for them," said Drews, 42.

The Dalai Lama, who fled to India after a failed uprising in 1959 in Tibet, arrived in the U.S. last week, a day after the Olympic torch run in San Francisco was changed to avoid a potential demonstration in protest of China's treatment of his people.

Protests have sprung up in Tibetan areas of western China since demonstrations in Lhasa turned violent on March 14.

About 100 pro-Chinese demonstrators rallied outside the basketball arena where Dalai Lama spoke. They waved Chinese and U.S. flags, and held posters showing support for the upcoming summer Olympics in Beijing.

"When the riots started (in China), our concern was how to tell the truth to the American people," said Jinhui Chen, a 34-year-old University of Michigan graduate student. He added: "We have a peaceful protest. We don't want to incite riots."

Saturday morning's appearance was the first of the Dalai Lama's four scheduled weekend talks at the university.

Three additional teaching sessions at the arena were planned for Saturday and Sunday under the sponsorship of the Jewel Heart Tibetan Buddhist learning center, The Tibet Fund and the Garrison Institute.

The Dalai Lama also plans a lecture on sustainability on Sunday sponsored the university's School of Natural Resources and Environment.

Upon submission of a written statement of the bona fide religious beliefs and opposition to the immunization requirements, the person may attend the college, university, school or facility without presenting a certificate of immunization. No child shall be exempt from the requirements of immunizations for the case of a personal belief or philosophy of a parent or guardian not founded upon a religious belief.

So what are they afraid of? if all the other kids vaccinated then what would they have to fear from my kid... they shouldnt get anything from my kid if the vaccine works.... also there is nothing in the articles saying how the school gets funding from the state if 100% of the kids are vaccinated, so thats why there is such a push for it to happen... money... there it is i said it... money... the govt wants the general public vaccinated so they get the schools to do the legwork getting everyone vaccinated with the promice of money.... but if you have enough $$$ your kids doesnt goto public school and you dont have to worry about your kid getting autism from the MMR shot... or the mercury that is STILL in the FLU shot. i could go on and on... but i wont, right now... just remember that most people in charge are driven by money and one of the largest money makers is in people being sick... cancer comes as a shot in the arm... - Az

The parents of more than 2,300 Prince George's County students who failed to get needed vaccinations could face fines of $50 a day and up to 10 days in jail if their children do not meet the state's immunization requirements, county officials said yesterday.

The threat of legal action is a last resort after months in which Prince George's has struggled to get its 131,000 students immunized for chicken pox and hepatitis B, as mandated by the state. More than 2,300 students have not been immunized and have been barred from attending schools, almost two months after a Sept. 20 deadline for meeting the requirement.

"We can do this the easy way or the hard way, but it's got to get done," Prince George's State's Attorney Glenn F. Ivey (D) said at a news conference in Upper Marlboro. "I'm willing to move forward with legal action."
School officials have made calls, sent letters and conducted home visits to make arrangements for free appointments for the needed shots. But often the students' addresses and phone numbers have been outdated, making contacting them difficult. Other students have received the vaccines but failed to get the necessary booster shots.

The school system turned to the justice system as a final option and received the backing of Circuit Judge William D. Missouri, the county's administrative judge, and Circuit Judge C. Philip Nichols Jr., who handles juvenile matters.

"This is an educational crisis," said R. Owen Johnson Jr., chairman of the school board. "This is a public health and a children's rights issue."

Nichols and Ivey sent another round of letters to the families still out of compliance. Nichols's letter ordered the parents to show up at Prince George's Circuit Court for a court hearing and a free vaccine; Ivey's letter warned that "unexcused absences by your child may subject you to a criminal charge."

They expect almost 1,700 children to show up Saturday with their parents for the first in a series of Circuit Court hearings on the matter. School officials said the parents would receive a verbal reprimand from the judge and be ordered to have their children immunized in the courthouse. The students would then be allowed to return to school.

Parents who do not appear could face fines of $50 for each day they fail to get their children immunized after being charged. They also could serve up to 10 days in jail. Ivey said he hoped charging parents would not be necessary.

"The goal is to get kids in school, not to put parents in jail," Ivey said.

Missouri said he looked forward to talking to the parents who had not gotten their children immunized, to understand why.

"I'd like to know exactly what the reasons are because the reasons may be able to be addressed without ratcheting it up to this point," he said.

Schools officials said they were sorry the crisis had gone this far, but that it needed to be solved immediately.
"This has really, really been a difficult time for us," said Betty Despenza-Green, the school system's chief of student services. "It hurts us when any child is out of school because he needs to be immunized, and so we felt we needed to be creative. We need those students immunized. We need them in schools."

On Nov. 17, Prince George, Maryland State's Attorney Glenn F. Ivy (D) and the county's public health and education officials are bringing the power of the State down on parents who have not gotten their children injected with vaccines for chickenpox and hepatitis B. In a Nov. 13 press release issued by the Prince George's County Public Schools (http://www1.pgcps.org/interior.aspx?id=30956 ) and at a press conference that day, state officials made it clear they were going to use whatever means they had to use to force the children to get vaccinated. Ivy said he was prepared to throw the parents whose children had not gotten their shots in jail: "We can do this the easy way or the hard way, but it's got to be done. I'm willing to move forward with legal action." The parents of children, who have been kicked out of school for failing to get their shots and are subject to truancy laws for failing to get their kids shots and are subject to truancy laws, are being summoned to the Prince George' County Courthouse in Upper Marlboro on Saturday with their children to get them vaccinated on site or face fines and jail time.

In two televised debates on CNN with longtime national vaccine policymaker William Shaffner, M.D. of Vanderbilt, and on MSNBC with Prince George's County Health Officer Donald Shell, M.D., I made the following points:

1) Terrorizing and threatening parents with jail time for not getting their children a chickenpox shot is not the way to handle the situation;
2) Some of the children may have had serious reactions to previous vaccinations and their parents are only trying to protect them from harm;
3) Even though it is unclear why all of the parents have not complied with the new vaccine requirements, when government officials use threats and intimidation to force parents to do what they want them to do, parents will fear and mistrust government officials;
4) There are many new vaccines being developed that will be added to the childhood schedule and what has happened in Maryland brings up the question that many parents are asking: How many more vaccines are children going to be forced to get to be able to get a public education? Many parents think too many vaccines are already required;
5) Chickenpox is not smallpox and hepatitis B is not polio. Hepatitis B is not an infection that can be transmitted in the school setting and chickenpox is mild for most children. These diseases do not fit the model of highly contagious diseases with a high rate of complications leading to permanent injury and death that have led to state vaccine requirements in the past;
6) Although Maryland and other states may allow medical and religious exemptions, they are very difficult for parents to obtain. Doctors cannot easily write medical exemptions that are not second- guessed by public health officials, who require strict adherence to narrow contraindications blessed by the CDC. Often parents, who attempt to file religious exemptions, are thrown into rooms and grilled about the sincerity of the religious beliefs;
7) Parents are wondering why every vaccine that industry produces is always automatically recommended for universal use by the CDC and then mandated;
8) The vaccine safety and informed consent debate is becoming more intense because more parents are reporting that their children are regressing into poor health after receiving many vaccines. Vaccines carry risks of seizures, brain inflammation and even death and often high risk children are not screened out of the program;
9) It is time for the people to take back the power - through their elected representatives - to decide which vaccines their children should have to take to go to school. In the past few decades, legislatures have given up their power to vote on which new vaccines will be mandated and have handed that power over to public health officials who have never met a vaccine they did not want to mandate;
10) The ethical principle of informed consent that applies to every other medical procedure that carries risks should also be applied to vaccination. Everyone should have the right to make an informed, voluntary vaccination choice.

There are many reasons why children do not receive vaccines. Some parents want to vaccinate their children but do not have access to public health clinics that are open during times that are convenient for parents. There may be cost and affordability issues. Others want to exempt their children from certain vaccines for reasons of religious belief or conscience but, as is the case in Maryland, cannot file a religious exemption unless they refuse all vaccines. Some may have children who have regressed into poor health after previous vaccinations and believe their children are genetically or otherwiseat high risk for suffering vaccine reactions but can't find a doctor to write a medical exemption and do not have religious beliefs that qualify them for a religious exemption. Others are opposed to all vaccine use because they have determined that vaccines are not necessary, safe or effective.

Whatever the reasons for parents not vaccinating their children with all state mandated vaccines, it is inappropriate for state officials to threaten parents with jail time. Reportedly, there are about 6,000 truant students in the state of Maryland. Are the parents of the other 4,000 students who are missing from school also being given deadlines and facing jail time their truant children?

Or could this military action by what some parents are referring to as "The Vaccine Police" be simply a case of an eager State's Attorney looking for a political platform teaming up with over-zealous health and education officials to achieve a 100 percent vaccination rate with all state-mandated vaccines in Maryland?

Whatever the case, hopefully the several thousand children showing up with their parents at the courthouse tomorrow to get vaccinated will be carefully screened for pre-existing health conditions that could put them at high risk for suffering severe reactions and their parents will be fully informed about how to monitor their children for symptoms of vaccine reactions. In the zeal to implement public policy, what health and education officials often forget is that individual responses to pharmaceutical products vary. The one-size-fits-all approach increases the risk of side effects for those genetically andotherwise biologically at higher risk and that is just one of many good reasons why the right to informed consent to vaccination is a human right.

Lawmakers heavily invested in defense

WASHINGTON - Members of Congress have as much as $196 million collectively invested in companies doing business with the Defense Department, earning millions since the onset of the Iraq war, according to a study by a nonpartisan research group.

Not all the companies in which lawmakers invested are typical defense contractors. Corporations such as PepsiCo, IBM, Microsoft and Johnson & Johnson have at one point received defense-related contracts, notes the report by the Washington-based Center for Responsive Politics.

The center's review of lawmakers' 2006 financial disclosure statements suggests that members' holdings could pose a conflict of interest as they decide the fate of Iraq war spending. Several members earning money from these contractors have plum committee or leadership assignments, including Democratic Sen. John Kerry, independent Sen. Joseph Lieberman and House Republican Whip Roy Blunt.

The study found that more Republicans than Democrats hold stock in defense companies, but that the Democrats who are invested had significantly more money at stake. In 2006, for example, Democrats held at least $3.7 million in military-related investments, compared to Republican investments of $577,500.

Overall, 151 members hold investments worth $78.7 million to $195.5 million in companies that receive defense contracts that are worth at least $5 million. These investments earned them anywhere between $15.8 million and $62 million between 2004 and 2006, the center concludes.

It is unclear how many members still hold these investments and exactly how much money has been made. Disclosure reports for 2007 aren't due until this May. Also, members are required to report only a general range of their holdings.

According to the report, presidential hopefuls Barack Obama and John McCain did not report any defense-related holdings on their filings; Hillary Rodham Clinton did note holdings in such companies as Honeywell, Boeing and Raytheon, but sold the stock in May 2007. All candidates three are members of the Senate.

Earning dividends from companies tied to the military "could be problematic" for lawmakers who oversee defense policy and budgeting, noted the center's Lindsay Renick Mayer. Avoiding every company with a military contract, however, would not be easy for an investor.

"So common are these companies, both as personal investments and as defense contractors, it would appear difficult to build a diverse blue-chip stock portfolio without at least some of them," Mayer wrote

Kerry, D-Mass., a member of the Senate Foreign Relations Committee, is identified as earning the most — at least $2.6 million between 2004 and 2006 from investments worth up to $38.2 million.

Spokesman David Wade said Kerry, who staunchly opposes the war in Iraq, is one of many beneficiaries of family trusts that he doesn't control. Wade also noted that Kerry does not sit on the Appropriations Committee, which has direct control of the defense budget.

"He has a 24-year Senate record of working and voting in the best interests of our men and women in the military, not of any defense contractors," Wade said.

Lieberman, I-Conn., chairman of the Senate Homeland Security and Governmental Affairs Committee and a member of the Armed Services Committee, held a considerably smaller share at $51,000. A spokesman said the senator, who supports continued operations in Iraq, is "careful to make his policy decisions based only on what is best for the country."

A spokesman for Blunt, R-Mo., a senior member of House GOP leadership who held at least $15,000 in Lockheed Martin stock in 2006, said the insinuation that lawmakers' votes might be affected by their portfolios is "offensive." Like Lieberman, Blunt has been a fierce supporter of the war.

"I don't pretend to speak for other offices, but I am fairly certain that no member would consider their personal finances when voting on issues as important as sending our men and women in uniform into harm's way," said Blunt spokesman Nick Simpson. The Lockheed Martin stock was given to Blunt's wife by her mother, he said.
